Firm’s Litigation Group Obtains Summary Judgment in Long Term Care Case
Dave Hennessy, a member of the firm’s Litigation Group, obtained summary judgment in a contentious case brought under the Illinois Nursing Home Care Act. Plaintiff alleged that the defendant facility was negligent and committed abuse and neglect for a large, deep laceration sustained by a resident. As the resident was being transferred from a wheelchair to a bed, his leg was lacerated by a part of the metal bed frame. This laceration required surgical repair; the wound also failed to heal, with the resident undergoing blood transfusions and follow-up surgeries. Plaintiff alleged violations under the Illinois Nursing Home Care Act, as well as general negligence, and sought monetary damages as well as attorneys’ fees. After extensive discovery, Dave Hennessy successfully argued that there was no material evidence of negligence, the staff performed the transfer within the standard of care, and that the facility’s staffing was appropriate.
